The Indian Penal Code i.e. Section 294 of the IPC has been made that if any man or woman performs any kind of obscene act on public, then the police can take action against them. However, no explicit definition of porn has been given in the law. This is why the police often abuse this law.
This means that if you do any of your friends or your loved ones or your spouse at the metro station, railway station, market, school or any public place, then the police can arrest you as obscene. In such a case, the police have been given the right under section 294 IPC.
Advocate Markandey Pant and Advocate Rajesh Sharma told that if anyone does somebody in public, then he may have a police action against him. He told that even if someone loses his girlfriend or boyfriend in public at the public place, then police action can be taken against him. They said that the case may be filed in public places in the public spaces in section 294 of any kind of obscene conversation and police can take action.
Advocate Rajesh Sharma said that under section 294 of the IPC, there has been a provision of punishment for three months and fine for felony acts. Apart from this, if someone sings pornography around or used obscene words, then the police can take action under Section 294 of the IPC against him.
